Terms of Service

Effective April 28, 2026

What Domaci is

Domaci is a platform that connects you with cafes and restaurants for online ordering and table bookings. We provide the tools — the cafe ("merchant") provides the food, drinks, and service. By using the platform you agree to these terms.

Your account

  • You must be at least 13 (or older where local law requires) to create an account.
  • You're responsible for activity under your account; keep your password safe.
  • You must give accurate information and update it when it changes.
  • You can place a guest order without creating an account. The same terms apply to your guest orders.

Orders and payments

  • Each order is a contract between you and the cafe. Domaci is not a party to that contract — we facilitate it.
  • Prices, availability, and preparation times are set by the cafe and may change. The price you see at checkout is what you pay, plus any delivery fee shown.
  • Payments are processed by our payment partner (Monri). By paying you authorize the charge. Failed payments mean the order isn't accepted.
  • The cafe may decline or cancel an order (e.g. items run out, kitchen overloaded). In that case the charge is reversed.

Refunds and disputes

Refund decisions are made by the cafe in line with their own policy and applicable consumer law. Contact the cafe first if something is wrong with your order. Domaci can help mediate but doesn't set the cafe's refund terms. If a charge is disputed and resolved in your favour, the refund is issued through Monri to the original payment method.

Bookings

Table bookings are requests, not guarantees. The cafe confirms (or declines) directly. Show up on time; some cafes hold tables for a limited window only. Cancellation policies vary per cafe.

Acceptable use

You agree not to:

  • Use Domaci to break the law.
  • Try to disrupt the service (scrape, spam, attack, attempt to access another user's account).
  • Place orders you don't intend to pay for, or use stolen payment instruments.
  • Misrepresent who you are.

We may suspend or terminate accounts that violate these rules.

Cafes (if you're a tenant)

If you operate a cafe on Domaci, separate commercial terms apply. In summary: you set your own menu, prices, hours, and order policies; you're responsible for fulfilling orders accepted in your name; you pay Domaci a SaaS subscription fee per location; payment processing is per your Monri agreement. Full merchant terms are in your onboarding agreement.

Intellectual property

The Domaci platform, including its software, interface, and trademarks, belongs to us. You get a personal, non-exclusive licence to use it for the purposes described here. Cafe content (menus, photos, descriptions) belongs to the cafe.

Disclaimers

We provide Domaci "as is" and "as available". We don't guarantee the platform will always be uninterrupted or error-free. We're not responsible for the quality, safety, or legality of food and drink served by cafes — that's the cafe's responsibility.

Limitation of liability

To the extent allowed by law, Domaci's total liability arising out of or in connection with the platform is limited to the greater of (a) the fees you paid us in the 12 months before the event giving rise to liability, or (b) €100. We're not liable for indirect, incidental, special, or consequential damages. Nothing in these terms excludes liability we're not permitted by law to exclude.

Termination

You can stop using Domaci at any time. We may suspend or terminate access if you breach these terms or if continuing to provide the service would expose us to legal or security risk.

Governing law

These terms are governed by the laws of Montenegro, without regard to conflict-of-laws rules. Any dispute that can't be resolved informally will be brought in the courts of Montenegro, except where local consumer law gives you the right to bring a claim elsewhere.

Changes

We may update these terms. If changes are material we'll update the effective date and, where appropriate, notify you by email or in-app. Continued use after the effective date means you accept the updated terms.
